On the 29th March 2021 the Government made 130 changes to the Residential Tenancies Act. Part of these changes are the new Compliance obligations around Minimum Standards including Gas and Electrical Safety checks, Smoke Alarm checks and Disclosure of information to prospective tenants.
Rental providers must ensure that the following checks are completed and reports be made available to renters upon request.
Gas and Electricity safety checks are to be conducted every two years, and
Smoke Alarm checks are to be conducted every 12 months.
Minimum Standards
Rental providers (landlords) must make sure a property meets minimum standards on or before the day a renter moves in.
If the property does not meet minimum standards, renters can end their rental agreement (lease) before moving in or they can request an urgent repair.
We will assist you with the required paperwork that needs to be completed and provided to the Renter and also assist with any repairs or upgrades required for your property to meet the minimum standards.
Disclosure Statements
Before signing a rental agreement, you must disclose certain information about the property to the renter. This will apply to all new agreements signed on and after 29 March 2021. You will need to have gathered this information and disclosed it before they sign an agreement. We can provide you with a form of what is required to be disclosed and also assist you in finding the required information.
We have simplified the process within our business for all of our Rental Providers by taking over the ongoing management of the safety checks through our preferred local trades. By using local tradespeople for all of our checks we are able to support other local business and manage the timeframes and cost of the checks. There are a lot of Melbourne companies offering checks however we have found that our local suppliers are more cost effective and are also available to attend in a timely manner and re-attend if there are any issues that arise from the checks being done.
We will coordinate the checks and also send you a reminder when the checks are due to be done again. The risk management of having the compliance checks and reports done on time and with great detail is so important as there are fines for lack of compliance.
